Terms and Conditions for Real Estate Media

1. Definitions

• "The Company": Refers to 1XEV Media, including its owners, employees, and authorized contractors.

• "Client": Refers to the real estate agent, broker, or representative who has booked services.

• "Deliverables": Refers to the final processed photos, videos, or aerial media provided to the Client.

2. Booking & Service Area

• Scheduling: Requests should be submitted via our online scheduler or email. A session is officially "Booked" only after both parties have confirmed the date, time, and location in writing.

• Travel Fees (from Winlock, WA):

  • First 50 miles: Included at no extra charge.

  • After 50 miles: $2.00 per mile for every mile exceeding the initial 50 miles.

  • Long Distance: For locations over 300 miles away, a $175 per night lodging stipend plus applicable mileage fees will be applied.

• Custom Quotes: For listings significantly outside our standard coverage area, please contact us with the full property address for a custom quote and availability.

3. On-Site Protocol

• Property Readiness: The property must be cleaned and staged prior to arrival. All properties are shot "As Is."

• Creative Direction: We strongly recommend the Client or a representative be present to approve the creative direction. If no one is present, the Photographer’s professional judgment will be deemed final and accepted.

• Post-Production: Requests for digital "de-cluttering" or item removal in post-production will incur additional editing fees.

4. Delivery & Turnaround

• Timeline: Final media is delivered within 24–48 hours, unless a specialized edit (e.g., high-end cinematic video) requires a custom timeline.

• Resolution: Photos are delivered in MLS-optimized resolution. High-resolution print files or specific social media aspect ratios (e.g., 9:16) must be requested at the time of booking.

• Re-shoots: Re-shoots due to factors outside our control (weather, furniture being moved after the shoot, etc.) are subject to a new session fee.

5. Cancellation & No-Show Policy

• 24-Hour Notice: Cancellations or rescheduling must occur at least 24 hours in advance.

• Late Cancellation: Made within 24 hours of the appointment: $25 fee.

• Last-Minute/On-Site: Made within one hour of the shoot or upon arrival: $75 fee.

6. Rights, Usage & Copyright

• Ownership: 1XEV Media retains full copyright ownership of all images and video produced.

• Client License: The Client is granted a non-exclusive, non-transferable license to use the media for marketing the specific property and self-promotion for the duration of the listing.

• Portfolio & Stock: 1XEV Media reserves the right to use any media captured for professional portfolio display, social media marketing, or stock media distribution, provided it does not violate privacy agreements regarding the property owner.

• Third-Party Use: Usage by third parties (contractors, stagers, or other agents) is strictly prohibited without written consent and a separate licensing agreement from 1XEV Media.

To help us get the best possible shots, please ensure all lights are on, fans are off, and vehicles are cleared from the driveway prior to our arrival!
